I own a rental home. The agent for a prospective tenant told me that I have to provide the tenant with a seller’s disclosure notice so the tenant knows as much as he can about the property. Do I have to provide the notice?
No. The Texas Property Code requires a seller’s disclosure notice in certain sales of property, but this requirement does not apply to any lease transactions. You could encourage the agent to bring the prospective tenant to view your property before the tenant submits a lease application. You may decide to tell the potential tenant he can request that you consider repairs or treatments should you both enter into a lease agreement. You can negotiate what type of repairs, if any, you will make.
